Noisy Apartment Neighbor Questions?

April 17th, 2009 | by Anthony |

looozaur asked:

Hello,

I have been dealing with noisy neighbors upstairs for many months now. It’s not that they play loud music, but they have a habit of stomping heavily on the floor, slamming their various cabinets and shelves, and dropping heavy objects onto the floor. I understand there is going to be a certain amount of noise anywhere you go, but this is causing me a lot of stress. It happens everyday, but mostly in the evenings and even in the wee hours of the morning. Those dropped objects make my heart pounce and frighten me greatly. I do believe they are doing it deliberately as I also had issues with their noisy dog before.

I reported this to management three times already, and nothing has been done.

I have had enough with the neighbors and management. I am now looking to move out soon. The lease says that to break the one year lease is 30 days notice and one month’s rent. Is there a way out of paying this? Can management “bad mouth” me in some way? I have always paid rent on time.

Have you tried talking to them? maybe they will respect you more if you went directly to them…

You already paid first last and security right? If you are unhappy just go and don’t pay another penny. They can have your last month’s rent and security and you are out. Don’t give him as a reference for your next place - that would be the only way he could bad mouth you and don’t leave him a forwarding address.

    Peace!

Try to do something wierd , like scream out to the top of your lungs whenever they stomp.

If you want to use the landlord as a reference, it would be best to adhere to the provisions of the contract.

In your 30-day notice, remind them of your complaints and let them know that’s why you’re moving. Save a copy. The loss of your rent might spur them into some kind of action against your neighbors…in a perfect world.

I live in a four thousand square foot home. My grandmother used to stay in the finished downstairs. She used ot say the same thing. I have cherry wood floors upstairs. We are not wespecially loud, but I have now learned that the sounds are amplified down there. Get busy, make lots of money and own your own home. It is the ultimate answer.

Did you ask to move to another apartment? If it’s after 10pm and the musics up call the cops or if the manager won’t do nothing about it then go above them, find the owners, if you have to ask the manager the owners address or number and mabey they’ll see you’re serious and do something and if not then go above them.

Have you tried talking to the people above you? Tell the management that they have failed to do anything about the problem so you should not have to pay any additional money. Did you pay a security deposit that could cover it?

Are they a property managment? I’d hop on the horn and tell the head cheese that the Better Business Bureau will be hearing aboot their disregard for the well being of their tenent’s.

If you have asked your neighbors politely if they could try to keep the noise down and then they refuse, then I don’t think there is much you can do about it. It is your word against theirs. Maybe you can ask your manager to visit during the time when the noise is happening and they can determine if you have a valid argument. Good luck.

Never wrestle with a pig, you’ll only get dirty and besides the pig likes it.
These people sound like pigs, I would take the loss and move out.

I’ve been thru this before living in an apt. in Qns. I can reall y feel for you here, lol.
1~There has to be an owner of the building-contact them w/ the problem and then I’d also report managemt. for their lack of responsibility as well.
2~If nothing else works, I wouldn’t even tell them I’m leaving till you have something else waiting andthen it would be at the latest possible moment & I’d tell them they can keep your security deposit for the last months rent.
3~Can they bad mouth you? Possibly-but I doubt it would come to that-plus they didn’t really take care of you either-right.
    Good luck.
